Résumé de la thèse
Linvestissement étranger est considéré aujourdhui comme un facteur clé voire une valeur ajoutée à même de faciliter le développement de lÉtat daccueil. Ainsi, chaque État mise sur lamélioration de son arsenal juridique interne dont lobjectif consiste à attirer de nombreux investisseurs et investissements étrangers sur son territoire. À cet égard, de réformes tendant à lamélioration de principaux textes juridiques applicables directement ou indirectement en matière dadmission et de sécurisation des investissements étrangers afin de se conformer aux standards internationaux deviennent une obsession pour lÉtat, dont la finalité demeure : la valorisation de ressources naturelles très souvent inexploitées et objet de plusieurs conventions dinvestissement.
Pourtant, il nexiste pas sur le plan international une législation homogène encadrant ladmission et la sécurisation des investisseurs étrangers ainsi que leurs investissements, puisque le droit international laissant cette liberté à chaque État souverain den décider librement, et ce selon sa politique économique, mais à une seule condition que, lÉtat respecte le minimum de standards internationaux prévus à cet effet. De ce fait, les efforts pour lÉtat devraient dune part, consistés à éviter léclatement, linadéquation et lobsolescence de règles régissant les investissements étrangers et quil devrait améliorer dautre part, le problème de linsuffisance de son droit interne applicable en matière de protection des investissements en recourant au droit international comme mécanisme complémentaire devant faciliter la correction des normes internes.
Thesis resume
Foreign investment is now considered a key factor or even an added value that can facilitate the development of the host country. Thus, each State is committed to improving its domestic legal arsenal, the objective of which is to attract many foreign investors and investments to its territory. In this respect, reforms aimed at improving the main legal texts directly or indirectly applicable to the admission and security of foreign investments in order to comply with international standards are becoming an obsession for the State, the purpose of which remains: the development of natural resources that are often unexploited and the subject of several investment agreements.
However, there is no homogeneous international legislation governing the admission and security of foreign investors and their investments, since international law leaves this freedom to each sovereign State to decide freely, in accordance with its economic policy, but only on the condition that the State respects the minimum international standards provided for this purpose. Therefore, efforts for the State should on the one hand avoid the fragmentation, inadequacy and obsolescence of rules governing foreign investment and should improve, on the one hand, the problem of the inadequacy of its applicable domestic investment protection law by using international law as a complementary mechanism to facilitate the correction of domestic standards.
