Résumé de la thèse
La protection de la santé est un droit fondamental, préalable à la jouissance des autres droits. Lun des moyens qui permettent den garantir le respect est sa constitutionnalisation et lintervention protectrice des juges constitutionnels qui résulte dune saisine soit a priori par les institutions ou a posteriori par les individus. Ceci constitue une mise en uvre des instruments internationaux de protection des droits, tel que le pacte international relatif aux droits socio-économiques et culturels qui exige des États une obligation négative et positive. Mais, si nous pouvons constater une avancée notable en France, dans les États dAfrique noire qui limitent cest un échec partiel. En Guinée ainsi quau Sénégal, en dehors de quelques arrêts liés au contrôle des conventions, telles que celle de lOrganisation mondiale de la santé consacrée à la lutte contre le tabagisme, tous les autres se rapportent aux élections. Le Bénin, en instituant un mécanisme daccès direct à sa Cour constitutionnelle, semble se distinguer. Il reste que, cette dernière, manque de créativité. Hormis lexégèse des normes constitutionnelles, quelle fait pour protéger le droit à la protection de la santé ou dautres droits qui y sont liés, elle ne se permet pas des créations prétoriennes. De plus, elle ne contribue pas à la construction de la loi, pour ainsi démontrer une véritable volonté de garantie. Pour remédier à ces insuffisances non exhaustives, nous envisageons une transposition du contentieux constitutionnel français qui, malgré les imperfections et critiques, contribue à la protection de la santé ou répond plutôt aux exigences de sa garantie réclamée aussi bien par les institutions que les individus à travers des mécanismes de saisines. Il surpasse celui de ces États dAfrique francophones quil a inspirés et qui se trouvent être, pour des raisons liées principalement à la similitude des structures administratives et à celle de la dualité des juridictions ordinaires (juridiction administrative et judiciaire dont les décisions sont contrôlées), condamnés à lui rester fidèles.
Thesis resume
The protection of health is a fundamental right, prior to the enjoyment of other rights. One of the means of guaranteeing its respect is its constitutionalization and the protective intervention of constitutional judges, which results from a referral either a priori by institutions or a posteriori by individuals. This constitutes an implementation of international instruments for the protection of rights, such as the International Covenant on Socio-Economic and Cultural Rights, which requires States to have a negative and positive obligation. But, if we can note a notable progress in France, in the black African States that imitate it, it is a partial failure. In Guinea as well as in Senegal, apart from a few rulings related to the control of conventions, such as the one of the World Health Organization devoted to the fight against smoking, all the others are related to elections. Benin, by instituting a mechanism for direct access to its constitutional court, seems to be distinguishing itself. However, the court lacks creativity. Apart from the exegesis of constitutional norms, which it does to protect the right to health protection or other related rights, it does not allow itself any praetorian creations. Moreover, it does not contribute to the construction of the law, thus demonstrating a real will to guarantee. To remedy these non-exhaustive shortcomings, we envisage a transposition of the French constitutional litigation which, despite the imperfections and criticisms, contributes to the protection of health or rather meets the requirements of its guarantee demanded by both institutions and individuals through referral mechanisms. It surpasses that of the French-speaking African states that it has inspired and which, for reasons linked mainly to the similarity of administrative structures and to the duality of the ordinary jurisdictions (administrative and judicial jurisdiction whose decisions are reviewed), are condemned to remain faithful to it.
