Résumé de la thèse
Affirmer lexistence de la notion de montage purement artificiel, cest admettre lévolution de la compétence de la Cour de Justice dans le domaine de la lute contre lévasion fiscale. Plus précisément, il sagit de reconnaitre son double pouvoir.
Le premier illustre le pouvoir créateur de la Cour de Justice. Face au développement du phénomène de lévasion fiscale et des itératives condamnations de dispositifs anti-abus nationaux, le juge de lUnion, de manière astucieuse, a introduit un remède permettant de prendre en considération tant la lutte contre lévasion fiscale que la préservation de lordre juridique de lUnion. Il sagit de la notion de montage purement artificiel. Ce qui a permet désormais aux États membres de disposer dun véritable référentiel lors de lédification de leurs dispositifs anti-abus nationaux.
Le second illustre le pouvoir fédérateur de la Cour de Justice. Face à lutilisation croissante de la notion de montage purement artificiel, lOCDE et le législateur de lUnion ont inséré de nouvelles clauses anti-abus. Ces dernières, largement influencées par la notion de montage purement artificiel, illustrent un mouvement des critères jusqualors prétoriens. Celles-ci disposent toutefois de subtilités textuelles quil convient de ne pas négliger au regard de latteinte potentielle quelle pourrait générer à légard du droit primaire.
Cette thèse démontre en quoi la notion de montage purement artificiel a permis à la Cour de Justice de rendre la lutte contre lévasion fiscale plus efficace tout en respectant lordre juridique de lUnion européenne.

Affirming the existence of the notion of purely artificial scheme results in acknowledging the development of the competence of the European Court of Justice within the framework of the fight against tax evasion. More precisely, it is a question of recognizing of its double power in this matter.
The first one illustrates the creative power of the Court of Justice. Faced with the development of the tax evasion phenomenon and the repeated censure of national anti-abuse measures, the European Court of Justice has cleverly introduced a remedy that takes into consideration both the fight against tax evasion and the preservation of the legal order of the Union by introducing the notion of purely artificial scheme. Referring to this new legal concept, European members have built their national anti-abuse measures.
The second one illustrates the federating power of the Court of Justice. Faced with the growing use of the concept of purely artificial scheme, the OECD and the EU legislator have not remained unconcerned and have introduced new anti-abuse provisions. The latter, largely influenced by the concept of purely artificial scheme, implies a commitment to codify the criteria that were previously applied by the courts. Nevertheless, they still contain certain textual nuances, in particular with regard to the "primarily tax" purpose. This is not without consequence with regard to current state interpretations. This could eventually lead to a potential infringement of the primary law of the Union. This implies that the Court of Justice will have to rule on the precise meaning of the purely artificial scheme.
This thesis demonstrated how the concept of a purely artificial scheme has permitted the Court of Justice to start fighting against tax evasion more effective while complying with the European Union's legal system.
