LARBITRAGE DANS LES LITIGES DES CONTRATS ADMINISTRATIFS
APPROCHE COMPARATIVE FRANCO-LIBYENNE
Larbitrabilité des litiges impliquant des personnes publiques demeure un sujet intéressant et discutable au sein de la doctrine administrative. Cette thèse essaie de répondre à la question de savoir dans quelle mesure les personnes publiques peuvent avoir recours à larbitrage dans les litiges relatifs aux contrats administratifs. Plus loin, la thèse cherche à savoir si larbitrage, en tant que mode alternatif de règlement des litiges, est réellement efficace et adapté aux systèmes juridiques français et libyen comparés.
La réponse à la question de la recherche, qui suit lapproche comparatiste, nous invite, dune part, à montrer létat des lieux des droits français et libyen en analysant systématiquement la question de larbitrage dans les litiges des contrats administratifs et, dautre part, à examiner ou rechercher un régime juridique de larbitrage applicable aux litiges des contrats administratifs. Dans ce contexte, la thèse sarticule autour de deux grandes parties. Dans la première sont examinées la question de linterdiction de larbitrage et celle de ladmission progressive du règlement des litiges administratifs par larbitrage. La deuxième partie, quant à elle, est consacrée à la recherche dun régime juridique de larbitrage applicable à la résolution des litiges des contrats administratifs. Elle examine notamment les problèmes se rapportant au processus et procédure darbitrage ainsi que le droit applicable dans les litiges impliquant des personnes publiques.

ARBITRATION IN DISPUTES OF ADMINISTRATIVE CONTRACTS
FRANCO-LIBYAN COMPARATIVE APPROACH
The arbitrability of disputes involving public persons remains an interesting and debatable subject within administrative doctrine. This thesis attempts to answer the question to what extent the public persons can resort to arbitration in disputes relating to administrative contracts. Further, this thesis seeks to know if arbitration, as an alternative dispute resolution, is really effective and adapted to the comparative French and Libyan legal systems.
The answer to the research question, which follows the comparative approach, invites us, on the one hand, to take stock of French and Libyan law by systematically analysing the question of arbitration in disputes of administrative contracts and, on the other hand, to examine or seek a legal regime of arbitration applicable to disputes of administrative contracts. In this context, the thesis is structured around two main parts. The first part examines the issue of the prohibition of arbitration and that of the gradual admission of the settlement of administrative disputes through arbitration. The second part, is devoted to the search for a legal arbitration regime applicable to dispute resolution in administrative contracts. In particular, it examines the problems related to the arbitration process and procedure as well as the applicable law in disputes involving public persons.
