Historiquement diluée dans les écrits d'obédience théologique en raison de sa propension à traiter de sujets pratiques plutôt que théoriques, la contribution théorico-légale mālikite a longtemps été reléguée au second plan, au profit des traditions ḥanafites et šafiʿites.
Cependant, au XIIIe siècle, le juriste Šihāb al-Dīn al-Qarāfī (m. 683/1285) met en évidence une tradition mālikite à travers ses écrits et incarne une véritable « grammaire du discours légal » synthétisés dans le compendium intitulé Tanqīḥ al-fuṣūl fī ʿilm al-uṣūl.
Dans cette perspective, ce travail interroge l'apport des mālikites en théorie légale musulmane en mettant l'accent sur l'influence portée par le légiste égyptien al-Qarāfī qui représente une véritable symbiose dans la doctrine mālikite, entre l'approche occidentale réputée plus normative, et l'approche orientale réputée plus spéculative.
Ainsi, l'objet de cette thèse est de présenter de manière fidèle la pensée légale de celui qui, désormais, est considéré comme le plus important théoricien mālikite de son époque en méthodologie du droit.
Pour ce faire, une introduction préliminaire vise à contextualiser la pensée d'al-Qarāfī, offrant une compréhension éclairée.
Cette étape constitue un préalable indispensable, ouvrant la voie à la traduction, l'analyse et le commentaire du traité Tanqīḥ al-fuṣūl fī ʿilm al-uṣūl qui fait autorité au sein de la doctrine.
En définitive, ces travaux offrent une vision approfondie sur la portée et l'influence de l'école mālikite dans le domaine juridique islamique, à travers la pensée spécifique d'al-Qarāfī.
Thesis resume
Historically diluted in theological writings due to its inclination toward practical rather than theoretical subjects, the theoretical-legal contribution of the Mālikī school has long been overshadowed, in favor of ḥanafite and šafiʿite traditions.
However, in the 13th century, the jurist Šihāb al-Dīn al-Qarāfī (d. 683/1285) highlights a Mālikī tradition in his writings and embodies a true "grammar of legal discourse" synthesized in the compendium titled Tanqīḥ al-fuṣūl fī ʿilm al-uṣūl.
From this perspective, this work scrutinizes the Mālikīs' contribution to Muslim legal theory, with a particular emphasis on the influence exerted by the Egyptian jurist al-Qarāfī, who represents a true symbiosis in Mālikī doctrine between the reputedly more normative Western approach and the reputedly more speculative Eastern approach.
The thesis aims to faithfully showcase the legal thought of the man regarded as the foremost Mālikī theorist of his time in legal methodology. This involves an introduction dedicated to contextualizing al- Qarāfi's thought, ensuring a well-informed understanding.
This introductory step serves as a crucial prerequisite foundation, laying the groundwork for the translation, analysis, and commentary of the authoritative treatise Tanqīḥ al-fuṣūl fī ʿilm al-uṣūl within the doctrine.
Ultimately, these works provide a profound insight into the extent and impact of the Mālikī school in the Islamic legal domain, specifically through al-Qarāfī's thought.
