Résumé de la thèse
La présente thèse propose une analyse juridique des transitions constitutionnelles internationalisées en tant quinstrument de reconstruction internationalisée de lÉtat à travers une étude de droit constitutionnel comparé et de droit international en se focalisant sur sept cas détude : lAfghanistan, la Bosnie-Herzégovine, le Cambodge, lIraq, le Kosovo, la Namibie et le Timor oriental. La problématique traitée appelle à sinterroger sur ladéquation de linstrument étudié au regard des fonctions qui lui sont attribuées par le droit international. Il sagit de déterminer si les caractéristiques de linstrument étudié sont adaptées à la réalisation des fonctions qui lui sont attribuées par le droit international. La thèse soutenue est que linternationalisation des transitions constitutionnelles conduit à une altération de leur fonctionnement présentant elle-même un risque au regard de la réalisation de ses fonctions.
Lanalyse du cadre juridique et des fonctions internationales attribuées à cet instrument, menée à partir du droit positif, permet de présenter les transitions constitutionnelles comme un moyen de règlement du différend et de reconstruction internationalisée de lÉtat. Laltération des transitions résultant de leur internationalisation se caractérise à travers la réalisation dune révolution juridique par une norme de droit international et une substitution temporaire dacteurs internationaux aux institutions gouvernementales internes. Linternationalisation du processus entraîne une dépendance du système créé aux acteurs internationaux et affecte la légitimité du droit qui en est issu, risquant dentraver la réalisation des fonctions de linstrument.
Thesis resume
This research is a legal analysis of internationalized constitution-making as an instrument of internationalized reconstruction of the State. It is a study of comparative constitutional law and international law focusing on seven case studies: Afghanistan, Bosnia and Herzegovina, Cambodia, Iraq, Kosovo, Namibia and Timor Leste. It addresses questions about the adequacy of the said process with regard to the functions assigned to it by international law. The aim is to determine whether the characteristics of the instrument under consideration are appropriate regarding the functions assigned to it by international law. It is argued that the internationalization of constitution-making processes leads to an alteration of their mechanisms which itself presents a risk to the fulfilment of its functions.
The analysis, based on positive law, of the legal framework and the international functions assigned to this instrument shows that international constitution-making is simultaneously a means of settlement of international dispute and of the internationalized reconstruction of the State. The international alteration of constitution-making process implies the realization of a legal revolution by international law and a temporary substitution of international actors to internal governmental institutions. The internationalization of the process leads to a dependency of the system created on international actors and affects the legitimacy of the resulting law, which may hinder the fulfilment of the functions of the instrument.
