Résumé de la thèse
Le mouvement « vers une plus grande transparence » qui se développe fortement depuis plusieurs années, est un concept désormais omniprésent au sein de nos sociétés, pouvant toucher de multiples secteurs, comme la sphère économique et financière, la vie publique, et même
le monde de la fiscalité.
Les travaux développés se questionnent sur le fait de savoir en quoi lémergence dun nouveau paradigme autour de la fraude et lévasion fiscales a entrainé lessor de la transparence fiscale par le biais de léchange automatique dinformations. Au-delà, en quoi léchange automatique dinformations peut être regardé ou non, comme lun des outils phares du nouveau modèle de transparence fiscale.
Le premier volet de recherches permet de faire état du contexte dans lequel les piliers de la lutte contre lévasion fiscale "2.0" ont été modelés, ainsi que les facteurs clés et pratiques dommageables persistantes qui ont motivé une telle évolution.
La volonté contemporaine de renouveler le système anti-fraude trouve son origine sur le plan conceptuel et sur le plan technique. En effet, lorsque lévolution des pratiques et des régimes fiscaux peut être tenue en partie responsable, il est important de souligner, quen droit interne français plus particulièrement, lassimilation des différents concepts et notions a eu un impact non négligeable en la matière. D'un point de vue contextuel et historique, le monde de lévasion fiscale sest peu à peu étendu et complexifié, sur le plan géographique et technique, rendant dautant plus populaires les scandales contemporains.
Cette motivation partagée jusquau niveau international a permis de voir naître et renaître de manière presque continue, un arsenal doutils communs dans la mise en place de la transparence fiscale au service de la lutte contre lévasion fiscale.
Les nombreux travaux de lOCDE sur la lutte contre lérosion de la base dimposition ont tenté de rétablir une certaine confiance en lintégrité fiscale, bien que ces efforts peuvent être jugés comme ayant des impacts limités. En effet, le plan BEPS découle de longs travaux et précédents rapports publiés par lOCDE.
Cependant, certains succès non négligeables de BEPS ne peuvent toutefois occulter le problème posé par la nature juridique du plan de lOCDE, et au-delà les obstacles dressés par un manque de consensus sur le plan international.
Le deuxième volet se consacre à létude des principaux mécanismes déchange automatique dinformation mis au service de la transparence fiscale dans le but de lutter plus efficacement contre la fraude et lévasion.
Le processus de transparence en matière de comptes financiers a été véritablement déployé par lémergence dun nouveau concept de transparence sous impulsion américaine, permettant aux autorités déchanger automatiquement entre elles les informations concernant les titulaires de comptes financiers.
Léchange automatique dinformations sur les comptes financiers ne fut véritablement instauré quà partir des années 2010, sous limpulsion dune législation américaine extraterritoriale, dont la mise en uvre eu inévitablement un impact significatif sur le plan international.
Ces diverses normes sont devenues au fil des années, les piliers de nouveaux mécanismes au service de la transparence, menant à de nouvelles réglementations déchange automatique, ciblés sur loptimisation fiscale.
Cest dans un contexte au succès modéré que le processus de transparence a été véritablement déployé, permettant aux autorités didentifier les contribuables qui évitent limpôt par le biais des techniques offshore, grâce à léchange automatique dinformations.
Thesis resume
The movement "towards greater transparency", which has been developing strongly for several years, is a concept that is now omnipresent within our societies, which can affect multiple sectors, such as the economic and financial sphere, public life, and even... the world of taxation.
The researches undertaken intended to answer the question of how the emergence of a new paradigm around tax fraud and tax evasion has led to the rise of tax transparency through the automatic exchange of information. And beyond, how the automatic exchange of information can be considered or not, as one of the flagship tools of a new model of tax transparency.
The first part of the research provides an overview of the context in which the pillars of the fight against tax evasion "2.0" were modelled, as well as the key factors and persistent harmful practices that motivated such a development.
The contemporary desire to renew the anti-fraud system has its origins conceptually and technically. Indeed, when the evolution of tax practices and regimes can be held partly responsible, it is important to point out that, in French domestic law in particular, the assimilation of the various concepts and concepts has had a significant impact in this area.
From a contextual and historical point of view, the world of tax evasion has gradually expanded and become more complex, geographically and technically, making contemporary scandals all the more popular.
This motivation shared up to the international level has made it possible to see the birth and rebirth almost continuously, an arsenal of common tools in the implementation of tax transparency in the service of the fight against tax evasion.
The OECD's extensive work on combating base erosion has attempted to restore some confidence in tax integrity, although these efforts may be seen as having limited impacts. Indeed, the BEPS plan stems from lengthy work and previous reports published by the OECD.
However, some of the significant successes of BEPS cannot overshadow the problem posed by the legal nature of the OECD plan, and beyond the obstacles posed by a lack of international consensus.
The second part focuses in more detail on the study of the main mechanisms for the automatic exchange of information put at the service of tax transparency with the aim of combating fraud and evasion more effectively.
The automatic exchange of information on financial accounts was not wholly introduced until the 2010s, under the impetus of extraterritorial US legislation, the implementation of which inevitably had a significant impact on the international level.
Over the years, these various standards have become the pillars of new mechanisms in the service of transparency, leading to new automatic exchange regulations, focused on tax optimization.
It is in a context of moderate success that the transparency process has been truly deployed, allowing the authorities to identify taxpayers who avoid tax through offshore techniques, through the automatic exchange of information. From this concept forged about ten years ago, has germinated an arsenal of European and national regulations, impacting to the same extent the financial sector but also any actor who can contribute to the feedback of information to their tax authorities.
