Résumé de la thèse
La présente thèsea pour thème,«lEtat et les coutumesau Cameroun de 1884 àlaConstitutionrévisée de 1996: contribution à une théorie pluraliste du droit en Afrique noirepostcoloniale». Ellese propose departiciper à la résolution de lacrise entrele droit produitpar lEtat et les pratiques socialesauCamerounet en Afriquenoire.Ainsi, après avoirdémontré lincompatibilité des politiques législatives de lEtat vis-à-vis descoutumes,cettethèse questionnelesdynamiquespropresauxsociétés coutumières. De sorte quil enressortdes principesdirecteursde la coutume, par le recours à la philologie historique,pour saisir sonsenspremier à partir des antiquitésafricaines.Ce faisant, sontruinéesla théorie unitaire delEtaten Afrique noire, son épistémologiefondatriceet sa prétention à incarnerdautorité,lordre et le droit. La présente thèseimpliqueainsi de redéfinir la coutumeetintroduitdeplein droitune nouvelle période de recherche fondamentale, à travers cetteconceptionnécessaire dans la perception même du paradigme localet son appropriation. Tout comme elleinduitdes mutations profondes et des rupturesqui permettent de réarticuler la connaissancedirecte desdeuxregistres normatifsen concours,etdorthographier autrementle vivreensemble.Dans la quête des institutions adaptées aux sociétés plurielles, lapportde cettethèse aura résidé dans la dé-marginalisationdu pointde vue des acteurs du paradigmecoutumierde régulation, souvent occultépar des idéologies autoritaires et des argumentscontrouvés, au service dune stratégie: la domination et la minoration du local
Thesis resume
The theme of this thesis is the state and customs in Cameroon from 1884 to the revisedconstitution of 1996: contribution to the pluralist theory inpostcolonial black Africa. Itproposes to participate in the resolution of the crisis between the law produced by the stateand the social practices in Cameroon and in black Africa. Thus,haven demonstrated theincompatibility of the legislative policies of the state vis-à-vis the customs, this thesisquestions the dynamics of the customary societies. So, itemerges from the guiding principleof customs, through the use of historical philosophy, to grasp its original meaning fromAfrican antiquities. In sodoing, the unitary theory of the state in black Africa, its foundingepistemology and its claim to embodyauthority, order and law are ruined. This thesis impliesredefining the custom and introduces a new period of fundamental research by right, throughthis conception necessary in the perception of the local paradigm itself and its appropriation.Just as itinduces profound mutation and breaks, that make it possible to re-articulate thedirect knowledge of the two normative registers in competitions, and to spell otherwise theirliving together. In the quest for institutions adapted to plural societies, thecontribution to thisthesis resided in thede-marginalization from the point of view of the actors of the customaryregulatory paradigm, often over shadowed by authoritarian ideologies and counteredarguments, in the service of strategy: the domination and the reduction of the locals
