Résumé de la thèse
Affirmer lexistence dun système fiscal international, cest admettre lexistence dune cohérence globale du droit fiscal international, conçu mondialement et non plus sous le seul angle des États souverains. Linvocation de plus en plus récurrente du système fiscal international dans le discours politique et juridique amène à sinterroger en quoi le droit fiscal international fait système. La recherche identifie ce système fiscal international en deux temps.
Une première identification, fonctionnelle, sattache à déterminer le but poursuivi par le système fiscal international. Après avoir rejeté laffirmation dun droit fiscal international à vocation neutralisante des effets néfastes du caractère international des situations sur la fiscalité, cette approche aboutit à rechercher lobjectif du système fiscal international dans les fonctions mêmes de limpôt : un objectif de rendement, pragmatique, et un objectif de justice fiscale, plus conceptuel, sous-tendent le développement du système fiscal international. Cette identification de la fonction du système permet daffirmer la primauté de sa dimension fiscale sur sa dimension internationale et de redéfinir le droit fiscal international à laune de ces buts.
Une seconde identification, structurelle, sattache à déterminer les acteurs et les mécanismes participant du système fiscal international. Revenant sur lévolution historique du droit fiscal international et sur le rôle tenu par les organisations internationales, cette approche met notamment en exergue la place particulière de lOCDE dans le système fiscal international et laction de la soft law internationale sur la hard law nationale.
Partant, le système fiscal international existe. Ce système est dynamique et son identification permet de poser les bases de ses évolutions futures, qui répondront aux mêmes contraintes conceptuelles et pragmatiques.
Thesis resume
To assert the existence of an international tax system is to admit the existence of a global coherence of international tax law, conceived globally and no longer solely from the perspective of sovereign states. The increasingly recurrent invocation of the international tax system in political and legal discourse leads to the question of how international tax law forms a system. The research identifies this international tax system in two stages.
A first, functional identification focuses on determining the goal pursued by the international tax system. After rejecting the assertion of an international tax law that neutralizes the harmful effects of the international character of situations on taxation, this approach leads to a search for the objective of the international tax system in the very functions of taxation: a pragmatic objective of yield and a more conceptual objective of tax justice underlie the development of the international tax system. This identification of the system's function makes it possible to affirm the primacy of its fiscal dimension over its international dimension and to redefine international tax law in the light of these goals.
A second, structural identification focuses on determining the actors and mechanisms involved in the international tax system. Reviewing the historical evolution of international tax law and the role played by international organizations, this approach highlights the particular place of the OECD in the international tax system and the action of international soft law on national hard law.
Therefore, the international tax system exists. This system is dynamic and its identification allows us to lay the foundations for its future evolution, which will respond to the same conceptual and pragmatic constraints.
