Résumé de la thèse

L’internationalisation et l’intensification des interactions entre systèmes juridiques ont eu pour effet une démultiplication du droit et de la production normative dans les États africains. Cette évolution a favorisé la juxtaposition de l’ordre juridique moderne et de l’ordre juridique traditionnel qui a provoqué un pluralisme normatif et juridictionnel dont la coutume et les spécificités culturelles sont au cœur du système africain de protection des droits fondamentaux. L’effectivité du pluralisme normatif et juridictionnel en Afrique, s’insère dans la mondialisation et la méthode par laquelle l’Afrique pense la simultanéité et construit la pluralité sans s’y enfermer. Cette démarche met en lumière la manière dont le système juridique africain s’adapte, crée ou subit les grandes mutations juridiques qui s’imposent à lui depuis l’avènement du constitutionnalisme libéral qui a permis la montée en puissance du juge constitutionnel dans les États africains. Dans cette perspective, d’une protection universelle émergente, la conciliation, l’interprétation et le dialogue des juges peuvent être utilisés par les juges internes en collaboration avec les juges supranationaux en vue d’assumer au mieux les nouvelles exigences de leur office. Thesis resume

The internationalization and intensification of interactions between legal systems have resulted in a multiplication of law and normative production in African states. This development has favored the juxtaposition of the modern legal order and the traditional legal order which has provoked a normative and jurisdictional pluralism whose custom and cultural specificities are at the heart of the African system for the protection of fundamental rights. The effectiveness of normative and jurisdictional pluralism in Africa fits into globalization and the method by which Africa thinks of simultaneity and builds plurality without locking itself into it. This approach sheds light on the way in which the African legal system adapts, creates or undergoes the great legal changes which are imposed on it since the advent of liberal constitutionalism which has allowed the rise of the constitutional judge in African States. In this perspective, an emerging universal protection, conciliation, interpretation and dialogue of judges can be used by domestic judges in collaboration with supranational judges in order to best meet the new requirements of their office.
